Welcome to the website and services of Mountain Trading House Inc. (“Mountain Trading House,” “we,” “us,” or “our”).

Mountain Trading House Inc. is a Canadian company providing point-of-sale (“POS”) systems, POS hardware, software solutions, payment technology, accessories, installation, configuration, technical support, and related services to businesses.

By accessing our website, requesting a quote, purchasing products or services, or using any services provided by Mountain Trading House, you agree to these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use our website or services.

1. Our Services

Mountain Trading House provides POS solutions and related products and services, which may include:

  • POS terminals and hardware
  • Touchscreen POS systems
  • POS software
  • Payment terminals and payment-related technology
  • Receipt printers and cash drawers
  • Barcode scanners
  • Kitchen display and kitchen printing solutions
  • Inventory and product management solutions
  • Employee and staff management features
  • Cloud-based reporting and business management tools
  • Online ordering and related integrations
  • Installation and system configuration
  • Technical support and maintenance
  • Other POS equipment, software, accessories, and related services

Specific products, features, software, payment processing services, warranties, support services, and pricing may vary depending on the solution selected by the customer.

2. Third-Party Products and Services

Certain POS systems or services offered by Mountain Trading House may incorporate, integrate with, or depend upon third-party products, software, payment processors, platforms, applications, or services.

Third-party services may have their own terms, privacy policies, warranties, fees, and requirements.

Mountain Trading House is not responsible for the operation, availability, security, policies, or terms of third-party services except to the extent expressly agreed to in writing.

Where applicable, customers are responsible for reviewing and complying with the terms of the relevant third-party provider.

3. Quotes and Pricing

Prices displayed on our website or provided through a quotation may be subject to change unless expressly stated otherwise in writing.

A quotation may include hardware, software, installation, configuration, support, subscription, licensing, payment processing, shipping, taxes, or other applicable charges.

Unless otherwise stated, applicable federal, provincial, and local taxes, shipping charges, installation charges, and third-party fees may be additional.

A quotation or proposal becomes binding only when accepted by Mountain Trading House or when the applicable order or agreement has been confirmed.

4. Orders and Payment

Customers agree to provide accurate billing, shipping, business, and contact information when placing an order.

Payment terms will be communicated at the time of purchase, quotation, or service agreement.

Mountain Trading House may require payment in advance, a deposit, recurring payment, financing arrangement, or other payment terms depending on the products or services purchased.

We reserve the right to decline or cancel an order where there is a legitimate reason, including product availability, pricing errors, suspected fraud, payment issues, or inability to fulfil the order.

5. Hardware

POS hardware may be new, refurbished, used, or otherwise specified in the applicable quotation or product description.

Hardware specifications, availability, compatibility, colours, dimensions, manufacturers, and included accessories may change without notice.

Customers are responsible for ensuring that the selected POS equipment is appropriate for their business requirements unless Mountain Trading House has expressly agreed in writing to provide such advice or configuration.

6. Software and Licensing

Certain POS solutions may include software that is licensed rather than sold.

Software may be subject to the applicable software provider's licence agreement, subscription terms, acceptable-use requirements, and other conditions.

Customers must not copy, modify, reverse engineer, decompile, distribute, resell, sublicense, or otherwise misuse software except where expressly permitted by applicable law or the relevant licence agreement.

7. Installation and Configuration

Where installation or configuration services are purchased, Mountain Trading House will perform the agreed services according to the applicable quotation or service agreement.

Customers are responsible for providing reasonable access to the premises, equipment, network, electrical connections, internet connection, business information, and other resources necessary for installation.

Delays caused by circumstances outside our reasonable control may affect installation or deployment timelines.

8. Internet and Network Requirements

Many modern POS systems require an internet connection, local network, cloud services, or other third-party infrastructure.

Mountain Trading House does not guarantee uninterrupted internet connectivity or availability of third-party networks and services.

Customers are responsible for maintaining suitable internet, electrical, networking, and other infrastructure unless these services are expressly included in a written agreement.

9. Payment Processing

Where a POS system integrates with payment processing services, payment processing may be provided by a third-party payment processor.

Mountain Trading House does not control the policies, availability, fees, settlement procedures, risk decisions, chargeback procedures, or approval decisions of third-party payment processors.

Customers may be required to enter into separate agreements with payment processors.

10. Customer Responsibilities

Customers agree to:

  • Provide accurate and complete information;
  • Use the POS system lawfully;
  • Maintain appropriate access credentials;
  • Protect passwords and administrator accounts;
  • Maintain appropriate internet and network infrastructure;
  • Keep software and equipment properly maintained;
  • Follow applicable payment-card, tax, privacy, employment, and business laws;
  • Maintain appropriate backups where applicable;
  • Prevent unauthorized access to POS systems; and
  • Notify Mountain Trading House promptly of suspected security incidents or unauthorized access.

Customers are responsible for transactions processed through their POS system and for ensuring that their business operations comply with applicable laws.

11. Returns, Cancellations and Refunds

Returns, cancellations, exchanges, and refunds are subject to the applicable quotation, purchase agreement, order confirmation, manufacturer's policy, or written return policy provided to the customer.

Certain products may be non-returnable or subject to restocking, cancellation, installation, shipping, licensing, or other applicable fees.

Customized, configured, installed, activated, or specially ordered products may have different return or cancellation conditions.

Where a third-party manufacturer or service provider controls the applicable warranty or return process, the manufacturer's or provider's terms may apply.

12. Warranties

Manufacturer warranties, software warranties, payment-provider warranties, and Mountain Trading House service warranties may vary by product or service.

Except where expressly stated in writing, Mountain Trading House does not provide warranties beyond those required by applicable law or expressly included in the applicable agreement.

Nothing in these Terms is intended to exclude or limit any consumer rights or statutory warranties that cannot lawfully be excluded or limited.

13. Technical Support

Support services are provided according to the applicable service plan, quotation, subscription, or agreement.

Support availability, response times, remote assistance, onsite assistance, software updates, and maintenance services may vary depending on the customer's service arrangement.

Mountain Trading House does not guarantee that every technical issue can be resolved immediately or that every issue is within our control.

14. Customer Data

Customers remain responsible for the business information and data entered into or generated through their POS system.

Customers are responsible for maintaining appropriate backups where applicable and for ensuring that their use of the POS system complies with applicable privacy and data-protection requirements.

Where Mountain Trading House processes personal information on behalf of a customer, the parties may be subject to additional contractual requirements.

15. Website Use

You may use our website only for lawful purposes.

You must not:

  • Attempt to gain unauthorized access to our website or systems;
  • Introduce malicious code or harmful software;
  • Interfere with website functionality;
  • Scrape, copy, or reproduce website content without permission;
  • Use our website for fraudulent activities;
  • Impersonate another person or organization; or
  • Violate applicable laws or regulations.

16. Intellectual Property

All content on our website, including text, graphics, logos, photographs, designs, trademarks, branding, software, and other materials, is owned by or licensed to Mountain Trading House Inc. unless otherwise stated.

You may not reproduce, modify, distribute, publish, or commercially exploit our intellectual property without our prior written permission.

Third-party trademarks and product names remain the property of their respective owners.

17. Availability of Services

We attempt to keep our website and services available and functional. However, we do not guarantee uninterrupted or error-free availability.

Services may be temporarily unavailable because of maintenance, upgrades, technical problems, internet failures, third-party services, security incidents, or circumstances beyond our reasonable control.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Mountain Trading House Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, data, or goodwill arising from the use of our products or services.

Our liability, where legally permitted to be limited, will be limited to the amount paid by the customer for the specific product or service giving rise to the claim during the applicable period preceding the event giving rise to the claim.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

19. Force Majeure

Mountain Trading House will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, fire, flood, severe weather, labour disputes, government actions, telecommunications failures, internet outages, supply-chain disruptions, transportation delays, cyber incidents, or failures of third-party service providers.

20. Changes to These Terms

We may update these Terms from time to time.

Updated Terms will be posted on our website with a revised “Last Updated” date. Continued use of our website or services after an update may constitute acceptance of the revised Terms to the extent permitted by law.

21. Governing Law

These Terms are governed by the laws applicable in the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Where legally permitted, disputes will be subject to the courts having jurisdiction in Alberta, Canada.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

23. Entire Agreement

These Terms, together with any applicable quotation, order confirmation, service agreement, software licence, warranty, or other written agreement, constitute the agreement governing the applicable use or purchase of our products and services.

If there is a conflict between these Terms and a specific written agreement, the specific written agreement will prevail to the extent of the conflict.
